A JUDGE JUDGE PANEL AGREED WITH ATTORNEY PHILIP IN MICHIGAN WHO ARGUED THAT MARKING TIRES IS SIMILAR TO POLICE SECRETLY PUTTING A GPS ON A VEHICLE WITHOUT A PROPER WARRANT. THAT’S A VIOLATION OF THE 4th AMENDMENT RIGHT AGAINST UNREASONABLE SEARCHS. THE IDEA OF TAKING A CHALK STICK AND SWIPING A TIRE TO USE AS A TOOL TO DETERMINE HOW LONG SOMEONE’S HAS BEEN IN A SPOT IS NOW UNCONSTITUTIONAL AS A VIOLATION OF YOUR 4th AMENDMENT RIGHTS. I WAS SHOCKED. I’M NOT AS PARANOID AND I HAVE TO NOT FORGET TO MOVE MY CAR. I THINK CHALK WIPES OFF EASILY, SO IT’S NOT A PROBLEM. THE COURT WHICH COVERS FOUR MIDWAY STATES RULED THAT A WARRANT IS NEEDED BECAUSE THE PURPOSE OF MARKING TIRES IS TO RAISE REVENUE AND NOT FOR PUBLIC SAFETY. SO SOMEBODY CAN RUN IN, RUN OUT AND NOT HAVE TO WORRY ABOUT GETTING A TICKET FOR JUST BEING PARKED FOR FIVE MINUTES LIKE YOU DO WITH OTHER TOWNS THAT HAVE PARKING METERS.   2. Whoever ordered this guy to keep chalking should loose their badge. As law enforcement officer you can't willingly defial the constitution. The court ruled it unconstitutional and so it's unconstitutional.

    One might think " well chalk goes away after a while." No, not when it enters the grooves of the tires it doesn't.

  10. Police in the city this was filed were not just chalking for parking. They were also chalking people that were parked at bars. Including workers, designated drivers, or people that just happened to be parked in the public lot. that was very well known 17 years ago; parking was not enforced in these lots during the times that they were marking tires

  12. In my hometown the cops put a chalk mark on the curb right in the center of the wheel and change the color of the chalk every hour. It's a 2 hour parking limit

  18. The vehicles are in public, if they take a picture of the vehicle; will that be considered the equivalent of gps? The same argument could be made that putting a citation on the window is the same as a gps tracker as the officials can predict to a high degree that citation will travel to the owners house. This is a bad ruling.

  19. Or maybe you could leave people alone and let them live their lives without arbitrary rules and fines? What does it matter tho, we are on the path to civil war soon anyway, all arbitrary rules will be wiped away and started fresh.

  21. Well if its ruled unconstitutional and the city told him to keep chalking. They are going to have cases brought against them for violating the constitutional rights from everyone that doesnt want to move their cars.

    When returning, take another picture.
    Issue a ticket if needed.
    Way cheaper than chalk and fancy stick.

  28. My buddy used to follow ticketeers just to piss them off, whether it be all out harrassing on site, follow them sneakily to their car and thrashing it parked or to their house to bust a couple of windows.
    This man delivered some justice, he did not deserve jail.
